Do not incriminate yourself

I love to hate to watch cop shows on TV or the movies where the bad guys tell the cops everything. I want everyone who reads this post to take only one thing away from it and it is this. The police main job is to arrest people despite what it says on the side of the car, so why would you tell them anything or help them in any way when they ask you questions when they are trying to their job which is to find a reason to arrest you?

Ask for a lawyer!

The police will ask you questions to confirm or to get more information to make a decision whether or not to arrest you, IF they have enough information they will arrest you regardless of if you talk or not! But if you don’t give them any additional information, by asking for a lawyer to be present during questioning, and they do not have enough evidence to arrest you, or they have marginal evidence to arrest you, you make the amount of work for your lawyer, who you pay for their time less, so you get cheaper lawyer fees.

Make the District Attorney Work For His Money!

If you are arrested, the District attorney (DA) will need to take the information that he has been given by the police and make a decision should they take it to court or not. District attorneys and assistant district attorneys are busy people and they like to be efficient, so given a choice many times they will dismiss the charges and you have escaped the machine for a lot less money than if you were a good citizen and gave the b everything that they needed to convict you and make the job of your attorney that much harder and that much more expensive.

Protect Your Legal Property Rights

Remember if a cop asks you for permission to do something like can you open the trunk or can you open the glove box up for me, tell them politely No, even if there is nothing in there. If they don’t need permission they are going to open it anyway! If you tell them no they need to decide if they have enough probable cause to search, if they search and they do not have a strong enough reason, any and all evidence that they gather will in most cases not be able to used against you. Basically as I understand it if you are not under arrest they can only search to protect there safety, so if you are speeding and do not resist in any way and they ask to search your trunk and you refuse to let them you could have 500 pounds of pot in there and they would in most cases not be able to use it in court if they opened the trunk with out your permission.
