By the hour is the way that any immigration lawyer would want to go as they have the potential to make the most money, and if there are problems specific to your case this is going to get you the best results, again, if the outcome is more important that the cheaper legal rates, going this way is really going to less expensive because if you don’t get the result that you want, a visa, then you wasted the money 100% no matter how much it was or how much you might have saved. The other downside is that if you get turned down for any reason it makes it very much harder the next time around you try to get into the USA.
There is another way that immigration attorneys will go and that is the guaranteed visa or you don’t pay. Sometimes this is a marketing come on or they have really tight rules to be eligible, like an airtight, no problem case, that you could have done yourself. Other times, especially if they are not lawyers but immigration specialists, they do the cookie cutter approach and charge more and still make the same money, if you fill the forms out completely, many will get accepted, some times by just dumb luck.
Then there are the very high-end immigration specialists and they will take a calculated chance on your case, based on their legal immigration experience and they will work it hard to get a big pay day. They will want some money upfront to keep you focused, then when they win, you pay much more, but for many having the guarantee or you pay very little to get a really good lawyer makes real sense if the goal is to get the visa and the money is important but the result is primary.

Did they suggest things like lying to US immigration or on the forms?
Did they seem reluctant to take your case?
Were they pushing for a lot of money upfront?
Did they say that you were going to need a lot of coaching?If yes to any of these questions then you probably have a red flag and you should try to find out what it is.
If they say it is straight forward no problem then you probably can go with the flat rate. But as always do your research, get recommendations and talk to as many qualified legal experts and try to trust your gut feel.
