The cheapest attorney you can ever get is the lawyer you don’t have to hire! I love to hate watching TV when it comes to the “cops” type of shows and the reason why is very simple, the people that they are arresting many times might not have gotten arrested if they were a little smarter about it and protected their legal rights. A good rule of thumb is if a cop has enough to arrest you he will, if he doesn't’t, but he thinks you might have done something, he will ask you a bunch of questions and try to get you to incriminate yourself and then he will arrest you, if you give him the responses he needs. The American system of law is adversarial which means that you have two sides, on your side is you and your lawyer and the other side is everybody else this includes your family and friends who might say something inadvertently while trying to help you that could actually hurt you!
We are trained that the police are our best friends and you should always cooperate with them, this is quite frankly happy talk and you need to file it with “I did not have sex with that woman” and “we need to eliminate these weapons of mass destruction”. If a police officer asks you for permission to do something, they are telling you that they cannot do the thing they are asking you to let them do, unless you give them permission to do so. Do not give them permission, if they proceed without permission there is a very good chance that your case will have problems for the prosecution, which is good news for you, it can have many possible outcomes including the case gets dismissed before it starts or a very favorable plea bargain or you win the case outright in court. Remember that law enforcement’s main job is to make arrests of people breaking the law; they are not going to go out of their way asking questions to try to help you get out of trouble.
If a policeman is asking you questions your response should be something like this in a neutral non abrasive tone “I have not done anything wrong, and I understand that if you want to ask me questions that I have a right to have an attorney present and I want an attorney present if you are asking me questions to protect my rights”. You should then shut up and not say anything. Many times they will say things to make you scarred that they are going to do something bad to you like take you in for questioning or arrest you if you don’t answer their questions. If they think that you have done something they are going to take you in regardless of if you answer there questions or not: by not answering the lawman’s questions you are not giving them a valid reason to arrest you; However, if you answer questions or give them evidence that supports their suspicion, or identify another law that you might have broken that they can prove against you, they will arrest you. If they can prove that you have broken other laws it will sometimes give them broader reasons for search, which can snowball against you. Remember anything and everything that you say will be used against you in a court of law!
If you do find yourself arrested, you still need to protect your rights, continue to keep asking for a lawyer and do not answer any questions until your lawyer tells you to. If you follow this advice is will save you money in lawyers’ fees and maybe even your freedom!
