DUI Law and Penalties in Oregon
Drunken driving laws and penalties in the state of Oregon are a bit overwhelming in just one glance. Once you really look deeper, you’ll see that their DUI laws and penalties are actually forgiving. You might encounter the phrase “diversion program”. It is one way to avoid getting stamped with a DUI conviction. You admit to a DUI charge, pay specific fines, attend an alcohol abuse treatment program maybe in Portland or somewhere else, avoid alcohol or prohibited drugs for a year, not figure in another DUI, and some other conditions. Upon completion, your DUI charge is expunged. Take note though, that the Diversion Program is only for first time offenders, literally.
After that the penalities are pretty harsh with 3 years on the SR22 high risk insurance this is going to cost you a bunch of money and if you don't carry it you are automatically suspended which means that you get charged with driving with out a lincence as well as any other charges you might be facing as a manditory part of your probation if it is a feloney driving offence you could get thrown into jail for a long time.
First Offense
- $1000 minimum to $2000 fine
- $500 fees for other combined penalties
- $75 license reinstatement fee
- $10000 maximum if accompanied by a minor below 18 years old and is 3 years younger than you)
- $50 maximum panel class fee
- 2-10 days minimum to 1 year maximum jail term, or
- 80 hours maximum community service
- From 18 months to 36 months of probation
- 1 year maximum license suspension
- Restricted driving permit (Hardship Permit) should there be no other DUI-related conviction on your record
- Installation of an Ignition Interlock Device (IID) for 1 year
- Proof of completed substance abuse treatment
- Proof of financial responsibility (SR22 insurance) good for 3 years
- Completed attendance of a Victim’s Impact Panel class
Second Offense
- $1500 minimum to $2000 fine
- $500 fees for other combined penalties
- $75 license reinstatement fee
- $10000 maximum if accompanied by a minor below 18 years old and is 3 years younger than you)
- $50 maximum panel class fee
- 1 month minimum to 3 years maximum jail term, or
- From 24 months to 36 months of probation
- 1 year minimum to 3 years maximum license suspension
- Restricted driving permit (Hardship Permit) should there be no other DUI-related conviction on your record
- Installation of an Ignition Interlock Device (IID) for 3 year
- Proof of completed substance abuse treatment
- Proof of financial responsibility (SR22 insurance) good for 3 years
- Completed attendance of a Victim’s Impact Panel class
Third Offense (and succeeding) – FELONY
- $2000 minimum fine
- $500 fees for other combined penalties
- $75 license reinstatement fee
- $10000 maximum if accompanied by a minor below 18 years old and is 3 years younger than you)
- $50 maximum panel class fee
- 3 months minimum mandatory jail term or permanent sentence
- From 36 months to 60 months of probation
- Lifetime license revocation
- Restricted driving permit (Hardship Permit) allowed only after serving 10 years of jail term
- Installation of an Ignition Interlock Device (IID) for 3 year
- Proof of completed substance abuse treatment
- Proof of financial responsibility (SR22 insurance) good for 3 years
- Completed attendance of a Victim’s Impact Panel class
