In addition to these, the state archipelago makes it really easy for peace officers to arrest you. Whether you passed the BAC legal limit (.08 reading is your ticket to DUI per se, .02 for those below 21 years old, and .04 for commercial drivers) or not, is not the end of it. You may still be arrested upon the conclusion of the peace officer who stopped you. Field sobriety tests, driving patterns, physical appearance, and other factors may open the DUI gates for you.
Like some of the states, Hawaii observes a five year look back period for DUI arrests and convictions. A person arrested again for DUI within 5 years elevates his offense to the next level (from first to second, from second to third, and so on). Needless to say, the world suddenly becomes complicated with just 1 instance of drunk driving.
When you are read your Miranda Rights excersise them if you are not to intoxicated and ask for a lawyer and shut up if you want a chance at a good DUI Defense.
