DUI Laws and Penalties in Maryland

Maryland DUI laws are different from those other laws that are implemented by the other states. Why? You can be arrested for either a Maryland DUI or a Maryland DWI. Drivers  are arrested for DUI, when found to have a BAC level of .08%, while a BAC level of .07% are arrested for DWI or less. Okay, this is not about picking which arrests you want.

  2. Fines amount from $500 to $3000
  3. License suspension from 60 days up to 18 months.


Below are the penalties specific to a DUI and DWI:
DUI
First Offense

  1. Jail time of 2  to 12 months.
  2. Fines amounting from $500 to $1,000.
  3. Suspension of your license for 60 days.
  4. 8 points added to your driving record.


Second Offense

  1. Maximum jail time of 2 years.
  2. Maximum fines of $2,000.
  3. License suspension of 120 days
  4. 12 points added to your driving record.


Third Offense

  1. Maximum jail time of 3 years.
  2. Maximum fines of $3,000.
  3. 120 days of license suspension or revocation is issued.



DWI
First Offense

  1. Maximum jail time of 1 year
  2. Maximum fines of $1000.
  3. Revocation of license for 60 days.


Second Offense

  1. Maximum jail time of 2 years.
  2. Maximum fines of $2000.
  3. Revocation of your license for 120 days.


Third Offense

  1. Maximum jail time of 3 years.
  2. Maximum fines of $3,000.
  3. Suspension of your license for 18 months
  4. Additional 1 year in jail and fines of $1000 if a minor was found to be in a vehicle


BAC levels of .05% and below may allow you to wash your hands  from an arrest, also if you are drinking and driving never underestimate the possibility a license suspension. You may be allowed to go home, however, always be ready with your DUI attorney for these serious matters. Maryland will do anything to keep its streets and highways away from vehicular accidents cuased by drunk drivers.
