Penalties for DUI in Michigan

DWI Laws and Penalties in Michigan

Michigan residents may start getting their driving license at the early age of 14. To do this, they must undergo the Graduated Licensing System which is broken down into three stages:

1. Driver Education Segment 1 for the Level 1 Learner License
2. Driver Education Segment 2 for the Level 2 Intermediate License
3. Level 3 License

Once all three stages have been completed, drivers may now acquire their state of Michigan driving license which they could use for at least 3 years. Take note that any traffic convictions may make their license become restricted or suspended.

Michigan has some of the toughest laws and penalties if you are a repeat offender and makes avoiding getting a first conviction all the more important. Having a good criminal defense lawyer that specializes in Michigan OWI could save you from jail time and having your car impounded or immobilized. They can ever take your licence plate to make sure that you cannot drive while under suspension for repeated OWI convictions.

In Michigan, you might want to use OWI (Operating While Intoxicated) instead of DUI, unless, you want them staring at you with a blank face. Below are the following drunk driving offenses in Michigan:

1. Operating while under the influence of intoxicating liquor (wines, beers, tequila, etc.)
2. Driving with an unlawful bodily alcohol level or content
3. Operating while impaired which is the least serious offense.

Michigan has increased their intolerance for drunk drivers. Their previous double standards for drunk driving have been simplified which is having a BAC level of .08%. Below are penalties for drunk driving:

8. Possible community service from 60 to 180 days.

In addition to the fines indicated per offense, Michigan OWI offenders are also required to pay a Driver Responsibility Fee of $1000 for 2 consecutive years. This is to be specifically paid by those convicted with Operating under the Influence or OUI while those convicted of Operating while visibly impaired or OWVI will be face a $500 penalty for 2 consecutive years. These are just some of penalties one will have to face. If you don’t want any trouble, driving while intoxicated or impaired with alcohol and/or drugs is surely not the best thing to do.

When you are read your Miranda Rights exercise them if you are not to intoxicated and ask for a lawyer and shut up if you want a chance at a good DUI Defense.
