Browsing through pictures and blogs about The Bluegrass State, it is surprising to know that almost half of recorded road mishaps in this 15-city state are caused by drunken driving. The state government may be promoting the unbridled spirit of Kentucky, but when it comes to DUI/DWI, it nips you right at the bud. It also implements the Zero Tolerance for underage drivers. Do not despair though, because you’re allowed to talk to your lawyer for 15 minutes before an arresting officer asks you to do a chemical test for BAC.
First Offense
- from $200 - $500 fine
- from 2 days minimum to 30 days maximum jail term ( 4 days minimum for AGGRAVATED)
- from 1 month minimum to 4 months maximum suspension of license
- from 2 days minimum to 1 month maximum of community service
- 90 days treatment for substance abuse in an accredited facility for such
Second Offense
- from $350 - $500 fine
- from 7 days minimum to 6 months maximum jail term ( 14 days minimum for AGGRAVATED)
- from 1 year minimum to 1 year and 6 months maximum suspension of license
- from 10 days minimum to 6 months maximum of community service
- 1 year treatment for substance abuse in an accredited facility for such
Third Offense
- $2500 fine
- from 3 months minimum to 1 year maximum jail term ( 6 months days minimum for AGGRAVATED)
- from 2 years minimum to 3 years maximum suspension of license
- from 10 days minimum to 1 year of community service
- 1 year treatment for substance abuse in an accredited facility for such
Fourth Offense (and succeeding arrests) - FELONY
- $2500 fine
- 6 months minimum jail term ( 8 months minimum for AGGRAVATED)
- from 5 years suspension of license
- possibility of serving 144 days of the jail term through a work release permit with the condition that the offender goes back to prison at the end of work schedule for the that day
- option to serve jail term in an accredited facility for substance abuse
To avoid getting charged for AGGRAVATED DUI, do not do the following;
- drive 30mph over the limit
- drive the wrong way on a highway with narrow access
- BAC level of .18 or more
- refuse a chemical test (breath test, blood, urine)
- drive and figure in a car accident with a minor in the vehicle (12 years old and below)
- figure in a vehicular accident that results in injury or death
When you are read your Miranda Rights excersise them if you are not to intoxicated and ask for a lawyer and shut up if you want a chance at a good DUI Defense.
