A DUI-related accident is reported every 48 minutes in Illinois as of 2011. In order not to be included in this list, you should not:
- Drink and drive
- Drive with an unsealed bottle of liquor in your vehicle
- Sell alcohol to minors
- allow minors to drink in your property or business establishment (including your children)
- allow someone intoxicated or with mental disorders to drive
- drive with no license, suspended license, fake license, or no insurance
- refuse a chemical test
With a total average cost of over $16, 000 for a DUI conviction, you would wish you never learned how to drink or drive.
First Offense
- $2500 maximum fine
- $500 additional (.16 BAC)
- $1000 additional (if with minor 16 years old or below)
- $2500 mandatory fine if minor was injured
- 1 year minimum of license suspension
- 1 year maximum jail term possible (+ 6months if with minor 16 years old or below)
- 100 hours minimum of community service (.16 BAC)
- 25 days minimum of community service (if with minor 16 years old or below)
- 25 days minimum additional if minor was injured
- Installation of an Ignition Interlock Device (IID) possible
- Vehicle registration suspension
- Substance abuse treatment
- High-risk insurance for 3 years
Second Offense
- $2500 maximum fine
- $1250 additional (.16 BAC)
- $25000 additional (if with minor 16 years old or below)
- $5000 mandatory fine if minor was injured
- 5 years minimum of license suspension
- 5 days mandatory maximum jail term (+ 2 days if with minor 16 years old or below)
- 240 hours minimum of community service (.16 BAC)
- 25 days minimum of community service (if with minor 16 years old or below)
- 25 days minimum additional if minor was injured
- Vehicle registration suspension
- Substance abuse treatment
- High-risk insurance for 3 years
Third Offense
- $2500 maximum fine
- $2500 additional (.16 BAC)
- $25000 additional (if with minor 16 years old or below)
- $5000 mandatory fine if minor was injured
- 10 years minimum of license suspension
- 90 days mandatory maximum jail term (if with minor 16 years old or below)
- 3 – 7 years jail term possible
- 25 days minimum of community service
- 25 days minimum additional if minor was injured
- Substance abuse treatment
- High-risk insurance for 3 years
Fourth Offense (and subsequent)
- $2500 maximum fine
- $5000 additional (.16 BAC)
- $25000 additional (if with minor 16 years old or below)
- $5000 mandatory fine if minor was injured
- Permanent revocation of license with no appeal
- 90 days mandatory maximum jail term (if with minor 16 years old or below)
- 3 – 7 years jail term possible
- 25 days minimum of community service
- 25 days minimum additional if minor was injured
- Substance abuse treatment
