Being in a job wherein I get to talk and be friends with a lot of people, I couldn’t help but notice that most of my guy friends who are recently divorced are either broke or miserable. Some are both. They miss their children because the court decided to limit their visiting rights to maybe just once a week or they are temporarily not allowed to see them at all. One guy friend from Denver got evicted from his 4-bedroom bi-level house and had to move to a 500 square feet studio apartment. He can only see his 4 kids every other Saturday, pay his ex-wife an alimony ‘coz she’s not earning enough to support the kids herself, pay child support for each child (which he does not mind, by the way), and has to take on a part time job (my friend is an industrial design engineer) just so he can pay his monthly rent and utilities. And like adding insult to injury, the family court ordered him to pay his ex-wife’s and those of his children’s lawyer’s fee amounting to almost fifteen grand. WOW! Is this real? You bet it is. I got other stories as tragic or even worse.
Now, maybe you’re just about to file a divorce, or be served with a notice. What do you do? Consult a divorce lawyer, that’s for sure. Can you get a free divorce lawyer? No, but there are lawyers who do some pro bono work including divorce. You can’t find one and you can’t afford one, what do you do? You can represent yourself (pro se waiver divorce) and do all the filings ($99) and the petitioning. You don’t know how and you have no time (you need at least 90 days), what do you do? Find a good lawyer that charges cheaply. What if you don’t have a lot of options in your area? Search online. There are about 29 million hits on divorce so better use specifics when you do your online search. There are websites that offer free advices and assessments, use those to ask questions. It’s better to sound ignorant by asking so many questions than by really being ignorant ‘coz you’re too proud to ask. Remember, ignorance excuses no one.
Okay, let’s say you found a couple of divorce lawyers online. Use that to ask specific questions about your rights during and after the divorce proceedings. Rights? Yes, male or female, you do have your rights in a divorce. Ask about: division of properties, custody and parenting time, alimony, child support in ratio to your salary, pre-nuptial agreements, paternity, dependency and neglect, etc. Ask, ask, and ask. Divorce proceedings take months at least. The service of a good divorce lawyer is a must as petitions and filings are on specific time frames or else you forfeit your rights on those issues. So go ahead, look for that lawyer and cross your fingers.
Colorado Legal Services is a legal resource for poor and the elderly they have some resources that are online that will help the DIY individuals like legal clinics and on line forms that you can access.
The courts themselves will have information if you ask them where it is to help thiose that don't meet the requirements for Pro Bono or free lawyers in Colorado.
