Protect Your Legal Rights Street Searchs
Remember the cheapest lawyer you can get, is the one you do not have to retain in the first place. One of the things that most people find hard to understand is that the best way to avoid some criminal legal problems is that if a cop asks you to do something that you do not have to automatically agree to it; This is very true when it comes to street searchs, You cannot physically resist, but it is in your best interst not to agree with street searchs.
One of the most common ways that people find themselves in court and in legal trouble is consenting to street searches, be it a physical pat down frisk on the street or searching you when you are asked to step out of a car. If you are asked permission, do not give it no matter what they say to you. They can say anything that they want to you to trick you into giving consent. They can boldface lie to you if they want.
Basically the cops are allowed to pat you down on the street looking for weapons to protect themselves from harm, obviously a little pot bud in a plastic baggie does not feel like a weapon, if there was nothing else in that pocket that felt like a weapon and they pulled it out you have a very good case to defend, and most likely get a good result; many times it would not make it to court as the District Attorneys office is usually not interested in spending resources on something this small, that has a good chance of being beaten in court, they will just dismiss it.
If you consent to any search the police can and will use anything and everything they find to get a conviction against you. The police have a job to do, and one of the main things that they are tasked to do is to make arrests. They do not get bonus points for letting people go that they have caught. It makes no difference to them if you gave permission or not, once they find something illegal they are going to process you, read that arrest you and feed you into the system. If you do not give permission and they do not search you and do not find anything illegal, they don’t have a reason to arrest you, so the process stops right there!
If you are asked for permission like “do you mind if I pull this out and take a look at it”? Say clearly, “I understand my legal rights, I am not resisting and I do not consent to this search”. At that point in time the police may continue to search, if they do find something illegal, do not admit any thing, just shut up and ask for a lawyer. And keep repeating whenever they ask you a question or make a statement. “I have done nothing illegal, I understand that I have the right to remain silent until I have a lawyer present to protect my legal rights, and I wish to exercise that right”.
