Eligibility Requirements for a K1 Visa Petition
- You and your fiancée must be eligible for marriage under the laws of India and the United States
- You will marry the petitioning U.S. citizen within 90 days of entering the U.S.
- You are entering the U.S. for the sole purpose of marrying the U.S. citizen
- Your first meeting with the U.S. citizen must have occurred within the previous two years prior to filing for the K1 visa. You may have the requirement waived only in meeting your fiancé would have violated long-established customs or would have created an extreme hardship for the U.S. citizen.
The K1 visa petition must be requested by the U.S. citizen from the United States Citizenship and Immigration Services (USCIS). When application is made, it must be accompanied by USCIS Form I-129F, Petition for Alien Fiancé. If children of the fiancé under the age of 21 will accompany them, they must be listed on this form. U.S. proof of citizenship must also accompany the petition.
After USCIS approval of the petition, it will be forwarded to the National Visa Center who will complete the initial processing for the K1 Visa. It is then forwarded to the American Consulate where you will be applying for the K1 visa. This petition, once approved will be valid only for a period of four months but can be extended by the consular office. The American Consulate will give you instructions and forms to complete the process.
